In plain words

(The full terms below are what apply.)

  • Your case is reviewed by a team selected for the decision you are facing. The team includes licensed doctors and may also include other healthcare professionals and other professionals whose expertise or perspective is relevant to your decision. We help you with a medical decision you are already facing. We go through the recommendation/s you received from your doctor/s or healthcare professional/s. We work with you to figure out if there is an option that hasn't been raised or was under-emphasised. We help you understand the evidence, uncertainties and trade-offs for each option taking into account your personal values and preferences. We do not tell you which one to choose. The decision is yours.
  • We do not take over your ongoing medical care. We do not diagnose, prescribe, order tests, write referrals, perform procedures, book appointments, or manage your case with your HMO (Kupa), insurer or hospital. Decisions about implementing an option discussed with us are taken forward with the healthcare professional responsible for that care.
  • You pay once, after your introductory call and before your session, for the whole accompaniment. It is not a subscription. You can cancel under Israeli consumer law.
  • We treat your medical information as sensitive and confidential. More information about how we collect, store, use and share it is in our Privacy Policy.
  • This is not emergency or urgent care. If you need urgent medical attention, contact your treating clinician or an appropriate urgent-care service. In an emergency call Magen David Adom 101, Police 100, Fire 102.

These Terms of Use ("Terms") govern the services of The Decision Clinic ("the Clinic", "we", "us").

The Decision Clinic is a collaboration of independent doctors, each licensed in Israel, each carrying their own professional liability insurance, and working together to offer this Service. In these Terms, "the provider" or "the providers" of the Service means the Clinic, together with the doctors and other professionals who take part in your case. When you book, your agreement is with the Clinic. Each doctor and professional remains responsible only for their own professional input, as described in Section 7.1.

By booking, accessing, or using the Service, you ("User" or "you") acknowledge that you have read and accept these Terms. These Terms, together with the signed "Before your session" consent form and any booking confirmation, are the whole agreement between you and the provider or providers of the Service.

These Terms are subject to the mandatory provisions of Israeli law, including the Patient's Rights Law, 5756-1996, the Consumer Protection Law, 5741-1981, and the Standard Contracts Law, 5743-1982. Nothing in these Terms reduces a right the law gives you.

Important: what the Clinic is, and what it is not

It is a medical decision-support service. It is offered by a collaboration of independent doctors, each licensed in Israel and working together. Licensed doctors review your case and discuss it with you. Other healthcare professionals or relevant professionals may also take part, depending on the decision you are facing ("the team"). The doctors participating in your case and on the team have a doctor-patient relationship with you for the scope of the medical service described in Section 1. We do not disclaim that relationship.

It is not your ongoing medical care. The Decision Clinic is not your ongoing medical care. We do not take over responsibility for managing your diagnosis, treatment or follow-up. Your treating clinicians continue to provide and be responsible for the diagnosis, treatment, procedures and follow-up they provide. Our role is to help you understand and weigh your reasonable options, including relevant options that may not previously have been offered to you, and to reach a decision that fits you.

If you want to pursue an option discussed during the Service, including one that has not previously been recommended to you, you will need to discuss it with the healthcare professional who would be responsible for assessing, prescribing, providing or arranging that treatment. Similarly, if you decide not to proceed with a treatment that has been recommended, you should discuss that decision and any appropriate follow-up with your treating clinician.

It is not emergency or urgent care. We do not monitor you between sessions. The Service is not intended to assess new or worsening symptoms. If your condition changes, contact your treating clinician. If something is urgent, do not wait for us: contact an appropriate urgent-care service, go to an emergency room, or call Magen David Adom on 101.

The website is not the Service or clinic. General content on our website, or anything you read outside your own case and sessions, is general information. It is not personal medical advice and does not create a doctor-patient relationship.

1. The Service

1.1 What you get

One accompaniment around one medical decision, made up of:

  1. An introductory call, to understand the decision you face and your circumstances, what you have been told so far, and what matters to you.
  2. Preparation: the team reviews your case based on the information and medical documents you provide and the recommendations you have received from your doctors and/or other healthcare professionals. The team may also review relevant medical evidence and guidance.
  3. A session: a structured video conversation with members of the team, with you present.
  4. A written summary of the session, in plain language, for you to keep and if you choose, share with your own doctors.
  5. A follow-up call, if included as described at booking.

1.2 How we work

Your case is reviewed by a team selected according to the decision you are facing. The team includes licensed doctors and may also include other healthcare professionals and other professionals whose expertise or perspective is relevant to your decision. We will tell you who will take part in your case and their role.

We start with the options and recommendations you have already been given, based on the available medical evidence, relevant clinical guidance where applicable, your circumstances, and the professional judgment of the people taking part in your case.

If, in the team's professional judgment, a reasonable and relevant option has not been raised, or has been under-emphasised, we may identify and discuss it with you. This does not mean that the option can or should be implemented without any further assessment that may be required by the healthcare professional responsible for providing that treatment.

For each option, we tell you what is known, what is still uncertain, its potential benefits and disadvantages, what it may involve for you, and how those trade-offs relate to your values, expectations, priorities and preferences. We also tell you where the evidence is uncertain, where reasonable professionals disagree, and when the honest answer is that nobody knows.

We help you think it through. We do not tell you which option to choose. The decision is yours.

Our information comes from your medical documents you shared with us, information you shared on the introductory call, the available published medical evidence and relevant guidance, and the judgment of the team taking part. Where the evidence is thin or does not fit your situation, we say so.

1.3 What is outside the Service

The Decision Clinic does not take over your ongoing medical care.

The Clinic does not, as part of the Service, diagnose a new medical condition, prescribe or change medication, order tests or imaging, perform examinations or procedures, write referrals, book appointments, or manage your case with your health fund, insurer, or hospital.

The discussion of an option during your session is not a prescription, referral or instruction to begin, stop or change treatment. Any medical action arising from your decision must be assessed and, where appropriate, implemented through the healthcare professional responsible for that aspect of your care.

1.4 What we cannot promise

We cannot promise a clear answer, agreement among everyone involved in your case, or a medical outcome.

The session is based on the documents and information you give us. We do not physically examine you and may not have access to all the information available to your treating clinicians.

The written summary we will provide records the discussion and the options considered. It is not a prescription, referral or medical order, and it does not replace the medical records held by your treating clinicians. If anything in it differs from an original document, the original governs.

1.5 Case review and right to decline or pause

After you send your documents, we check that your case fits the Service.

We may decline, pause or end an engagement if we believe that we do not have sufficient information to review the decision safely; the case requires a physical examination, diagnosis, urgent assessment or another service outside the scope described in these Terms; the patient's condition has materially changed; appropriate professional expertise is not available; or we otherwise believe that proceeding would not be clinically appropriate.

If that happens, we will tell you as soon as reasonably possible and, where appropriate, advise you to return to your treating clinician or seek another form of medical assessment.

1.6 Recording, transcription and AI

We may record your introductory call and your session. Recordings may also be transcribed using functionality provided by the secure video or communications platform used for the call or session.

We use recordings and any transcripts to maintain an accurate record of your case, allow the team to prepare and review relevant information accurately, prepare your written summary, conduct quality review, and resolve questions about what was said.

If you do not consent to recording, we will take written notes instead. Further information about recordings, transcription, storage, access and retention is provided in our Privacy Policy and in the consent process before your session.

Our doctors may use AI tools to help research medical literature relevant to your case, but only with general clinical questions that contain no identifying details. We do not provide general-purpose generative-AI tools used for this purpose with your name, medical documents, recordings, transcripts or other information that identifies you.

AI tools do not make decisions about your care. Any information obtained using an AI-assisted research process that informs your session is reviewed by a licensed doctor or other appropriately qualified professional, who remains responsible for the professional input they provide.

If we ever materially change how we use AI with identifiable patient information, we will update our policies and obtain any additional consent required before doing so.

1.7 Your responsibilities

  1. Accurate information. Give us accurate and, as far as you know, complete information and documents relevant to the decision. The session can only reflect what we receive.
  2. Tell us if something changes. If your medical condition, symptoms or circumstances materially change after the information or recommendation we are reviewing, tell us and contact your treating clinician where appropriate. Do not wait for a Decision Clinic session to seek assessment of new or worsening symptoms.
  3. Compliance with law. You agree to comply with all applicable laws and regulations, including, but not limited to, those pertaining to privacy and data protection under Israeli law.
  4. Someone else's information. If you share information about another person, such as a family member, carer, doctor or other healthcare professional, you confirm you have their consent or other lawful authority to do so where this is required.
  5. Age. The Service is currently available only to patients aged 18 or over.
  6. Location. The patient must be in Israel when receiving the Service.

1.8 Acceptable use

Do not give false information or impersonate anyone, try to access other people's information or our systems without permission, copy or scrape the website or platform, or use the Service unlawfully. We may end your access if you do, under Section 4.2.

2. Your Information

Your medical information is sensitive information. We collect and use it to provide the Service, maintain the medical record, keep your information secure, comply with our legal obligations, and for the other purposes described in our Privacy Policy.

Information relevant to your case may be available to the professionals taking part in your case and to service providers that we need to operate the Service, subject to the safeguards and limitations described in our Privacy Policy.

You can ask for access to, or a copy of, what we hold about you and exercise the other rights available to you under applicable law. We keep your medical records for the period Israeli law requires, under the Public Health Regulations (Medical Records Retention), 5737-1976, so a deletion request may not cover them until that period ends.

Our Privacy Policy explains in more detail what information we collect, who is responsible for it, where and how it is stored, who may access it, the service providers we use, how long information is retained, your rights, and how to contact us about privacy.

3. Price and Payment

3.1 Price

The price is the one shown when you book, including VAT, and covers the whole accompaniment in Section 1.1. It is agreed when you book and paid in full once, after your introductory call and before your session. There are no recurring charges. The introductory call is free unless you are told otherwise before booking.

Your payment is received by the provider designated by the Clinic, whose name and business details appear on your booking confirmation and on the receipt you receive.

3.2 Cancellation and refunds

  1. Before your session, you may cancel at any time, without giving a reason, and you will receive a full refund.
  2. Your statutory right. You may also have cancellation rights under the Consumer Protection Law, 5741-1981 and other applicable law. Nothing in these Terms limits those rights. If you cancel under these provisions, any cancellation fee, deduction for Services already provided, and timing of the refund will be determined in accordance with applicable law.
  3. If a refund is due, it is made to the original payment method within 14 business days, unless another method is required.

To cancel, email the-decision-clinic@healthei.io with your name and booking details. We will confirm receipt.

3.3 Price changes

We may change our prices. A change never affects a booking you have already made.

4. Ending the Engagement

4.1 By you

You may stop at any point, before, during, or after the session, without giving a reason. Payment and refunds follow Section 3.2.

4.2 By us

We may end or pause the engagement if:

  • your case is no longer suitable for the Service for one of the reasons described in Section 1.5;
  • continuing the Service would, in our professional judgment, be inappropriate or unsafe;
  • you materially breach these Terms;
  • you misuse the Service or behave abusively or unlawfully towards a member of the team; or
  • circumstances outside our reasonable control prevent us from safely providing the Service.

Where reasonably possible, we will explain why the engagement is being ended or paused.

If we end the engagement for a reason other than your breach or misuse of the Service, you will not be charged for the part of the Service not provided, and any refund due will be dealt with under Section 3.2 and applicable law.

4.3 What survives

Sections 2, 5, 6, 7, and 8 continue after the engagement ends.

5. Intellectual Property

The website, platform, and materials we use to run the Service belong to the Clinic. You may use them only for your own accompaniment, and may not copy, modify, resell, or reverse engineer them.

The materials made available to you as part of the Service may be used by you for your own personal healthcare and decision-making purposes. You may keep and share your written summary, including with your own healthcare professionals.

Nothing in these Terms prevents you from accessing, using or sharing your own medical information in accordance with your rights under applicable law.

6. Confidentiality

We treat your information as confidential and use and disclose it only as permitted by law and as described in these Terms and our Privacy Policy.

Doctors and other regulated healthcare professionals taking part in your case remain subject to the professional and legal confidentiality obligations applicable to them.

Other members of the team who are given access to information about your case are required to keep it confidential and to use it only for the purposes of providing the Service.

If we become aware of unauthorised access to your information, we will take appropriate steps to contain and address it and will make any notification required by law.

We apply security measures appropriate to the sensitivity of your information, as described in our Privacy Policy.

7. Responsibility and Liability

7.1 Professional responsibility

A session is a medical encounter insofar as licensed doctors provide medical input to you as part of the Service. Other healthcare professionals and other relevant professionals may also participate and contribute within their respective professional roles and expertise.

Before your session, we will tell you who is taking part and their role.

The doctors taking part are independent physicians, each licensed in Israel, each carrying their own professional liability insurance, and working together to offer this Service. Each participating professional is expected to act within their professional competence and to exercise their own professional judgment in relation to the input they provide. Each team member is solely responsible for the guidance under their expertise.

Nothing in these Terms excludes or limits responsibility that cannot lawfully be excluded or limited.

7.2 Technology

We do not promise the website, platform, or video connection will always be available or free of technical errors.

If a session cannot take place, or has to stop, for a technical reason on our side, we will reschedule it or refund you.

Nothing in this section limits any right you have under applicable law.

7.3 Information about other people

If you share someone else's information without their consent or authority, you may be responsible for consequences arising from doing so, where their consent or other lawful authority was required.

This does not apply to anything caused by our own negligence or breach of these Terms, or failure to comply with our legal obligations.

8. General

Complaints. You can tell us at the-decision-clinic@healthei.io. Nothing in these Terms requires you to complain to us before exercising any right to contact a regulator, professional body or other authority available to you under Israeli law.

Governing law and courts. These Terms shall be governed by the laws of the State of Israel. Any disputes will be resolved by the competent courts in Tel Aviv, Israel.

Language. These Terms are written in English. If we provide a translation and the versions differ, the English version governs.

Notices. We may contact you at the email address or other contact details you provide when booking. You can contact us at the-decision-clinic@healthei.io.

Electronic acceptance. You may accept these Terms and sign the consent form electronically.

Changes to these Terms. We may update these Terms. The version you accepted at booking applies to that accompaniment unless a change is required by law or you expressly agree to a later version.

Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, including war, emergency, epidemic or pandemic, cyberattack, a major system or internet outage, failure of a third-party service we rely on, or a change in law or a court or regulatory order that prevents us from providing the Service. If a session cannot take place because of this, we reschedule or refund the appropriate part of the Service.

Transfer. You may not transfer this agreement. We may transfer it to another practice or entity that takes over operating the Clinic, on notice to you.

Severability. If any provision of these Terms is held by a court of competent jurisdiction to be illegal, invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
